Medico-Legal Experience

Jane founded her firm in 2011 and expert witness work became a particular passion. Specialising in helping vulnerable clients who have experienced catastrophic injuries, assisting with some of the most disabled and vulnerable members of society. Jane’s expert witness work has also led her to referrals for catastrophic injury deputyships, professional trusteeships and Litigation Friend appointments.

Jane is instructed to act as a Deputy by Local Authorities in large value, complex cases, and is regularly instructed to assist in resolving disputes between family members and the Local Authority.

Jane is instructed to act as a Deputy by Local Authorities in large value, complex cases, and is regularly instructed to assist in resolving disputes between family members and the Local Authority. Ms Bennett also acts as a Personal Welfare Deputy and a Professional Attorney regarding health and financial matters. She is an Expert Witness in high-value, catastrophic injury
cases and prepares professional deputyships, best interests, and professional trustee costing reports for the High Court on the instructions of leading Claimant and Defendant law firms. Ms Bennett also advises on community and social care law and their impact on mental capacity, safeguarding and Local Authority/NHS funding matters.

Jane’s appointment availability is around 2-4 weeks and has a report turnaround time of 4-6 weeks. 

Clinical Experience

Jane has been a qualified solicitor Court of Protection for over 25 years. For 20 years, Jane has been specialising in working with clients in vulnerable circumstances and is fully accredited by Lifetime Lawyers Association (formerly Solicitors for the Elderly). She now acts as a professional deputy for over 190 clients and her firm acts for over 300 deputyships clients, with several other appointments pending.

Jane provides advice on all possible types of applications to the Court of Protection, this includes matters regarding gifts and transfers; the impact and  implications of lack of capacity regarding other types of legal proceedings; Wills, including tax-efficient Wills; Wills catering for disabled beneficiaries; Statutory Wills for those who lack mental capacity to make a will. Jane’s professional memberships also include: Action for Elder Abuse, Brain Injury Social Work Group, Headway and Spinal Injuries Association, and  Affiliate of STEP.

In a number of cases, Jane also acts as a professional trustee for individuals with spinal cord and/or cerebral palsy related injuries. Ms Bennett regularly writes articles in legal publications
regarding Court of Protection and Deputyship issues. She gives talks in professional circles in regard to Court of Protection and community law matters as well as areas surrounding elderly clients and actively contributes to academic research regarding developments of the law in terms of mental capacity.
